Terms & conditions
The terms on which you hold a membership at ODAAT Fitness, book a class, and use the gym.

This document is a starting point written to reflect how the website and gym actually work. It is not legal advice, and it has not been reviewed by a solicitor.
1. Who these terms are with
These terms are an agreement between you and [to be confirmed: the legal entity — limited company or sole trader — and its exact registered name], trading as ODAAT Fitness, of Unit 12, West Bowhouse Workshops, Irvine, KA11 1PR(“we”, “us”).
By joining as a member, booking a class, or using the gym, you agree to these terms, to our house rules, and to our privacy policy.
2. Membership
Memberships are monthly rolling. There is no minimum term and no joining fee. Your membership continues month to month until either you or we end it in line with section 4.
Current membership types and prices are shown on our membership page. They are:
- Over 65s — £20 per month
- 24-Hour — £30 per month
- Couples — £54 per month, covering two named people
- PT Membership — from £50 per month
- PT Plus — £110 per month
- PT Sessions — £25 per session, no membership required
A Couples membership covers two named individuals living at the same address. It cannot be shared with, or transferred to, anyone else.
Your membership is personal to you. You must not let anyone else use your access method to enter the gym. Doing so may result in your membership being ended under section 9.
3. Payment
Membership is paid monthly in advance. Your first payment is due when you join, and subsequent payments are due on the same day each month.

If a payment is missed, we may suspend your access until it is brought up to date. We will always try to contact you first.
4. Cancelling your membership
4.1 Your 14-day right to cancel a membership bought at a distance
Membership is currently arranged by WhatsApp, phone or social media rather than in person at the gym. That makes it a distance contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and it means you have a legal right to change your mind.
You may cancel within 14 days of agreeing to join, for any reason, and get your money back. The 14 days run from the day your membership is agreed. You do not need to give a reason.
To cancel, just tell us clearly — a WhatsApp message, a phone call, or a letter to the address above is enough. We will refund you within 14 days of being told.
One thing to be aware of: if you ask us to start your membership straight away (for example, so you can train the same day) and then cancel within the 14 days, we may keep a proportionate amount for the days you actually had access. If you want to keep the full refund available, say so when you join and we will not start your access until the 14 days have passed. We will not charge you anything if we have not yet given you access.
This right sits on top of — and is not replaced by — the ordinary notice arrangements in 4.2.
4.2 Cancelling after the first 14 days
After the first 14 days you can cancel your membership at any time by telling us. Because memberships are monthly rolling, cancelling stops future payments; it does not refund the month you are currently in, and you keep access to the end of the period you have paid for.

If you pay by standing order, please remember to cancel it with your own bank as well. We cannot stop a standing order on your behalf.
4.3 Pausing
We can pause a membership in some circumstances — for example injury or a long period away. Ask us and we will do what we reasonably can.
5. Price changes
We may change membership prices. If we do, we will give you at least 30 days’ notice in writing (including by WhatsApp or email) before the new price applies to you. If you do not want to pay the new price, you can cancel before it takes effect and you will not be charged the increase.
Prices already paid for a current month will not change.
6. Gym access and opening
Members have access 24 hours a day, seven days a week, using the access method we give you when you join.
The gym is not staffed at all times. For long periods there will be no member of staff on the premises. Section 8 and our house rules explain what that means for how you should train.
We may need to close the gym, or part of it, for maintenance, repairs, cleaning, or reasons outside our control. We will give notice where we can. Short closures do not entitle you to a refund, but if the gym is closed for an extended period we will credit or refund a fair proportion of your membership.
6.1 Age

Until this is confirmed, please contact us before joining if the member would be under 18.
7. Booking classes and events
Classes can be booked through this website. Places are capped. If a class is full you can join the reserve list, and if someone cancels we will move the next person on the list into the class automatically and email them.
Please cancel if you cannot make it — there is a link in your confirmation email that cancels your place and frees it for someone else. Repeatedly booking and not turning up may lead to us limiting your booking.
We may cancel or reschedule a class, for example if a coach is unwell. We will tell you as soon as we can.
Some events listed on the site are run by other organisations. Where that is the case, we are only telling you about them — your booking and any payment is with that organiser, under their terms, not ours.
8. Your responsibilities and health
You are responsible for training in a way that is safe for you. In particular, you agree that:
- you will not train if you are unwell, injured, or have been told by a doctor not to;
- if you have a health condition, are pregnant, are recovering from injury or surgery, or are unsure whether exercise is suitable for you, you will speak to a doctor or other suitably qualified healthcare professional before training with us;
- you will use equipment properly, within your own capability, and in line with any instructions on or near it;
- you will tell us about anything relevant to your safety that we could not reasonably be expected to know; and
- you will follow our house rules, including those about training during unstaffed hours.
Exercise carries inherent risk. We take reasonable care of the gym and its equipment, but we cannot remove that risk, and you accept it when you train here. Before your first class booking we ask you to confirm you have read a short set of pre-exercise questions and an acknowledgement of that risk.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law. Beyond that, we are not liable for loss or damage that was not foreseeable, or for loss or damage to your property brought onto the premises, except where it is caused by our negligence.
9. Behaviour, suspension and termination
ODAAT Fitness is a small gym and it works because people look after it and each other. We ask that you treat other members, staff and the premises with respect.
We may suspend or end your membership immediately if you:
- behave abusively, aggressively, or in a way that puts others at risk;
- damage equipment or the premises deliberately or recklessly;
- let someone else use your access to get into the gym;
- train under the influence of alcohol or drugs;
- seriously or repeatedly break these terms or our house rules; or
- fail to pay after we have asked you to.
If we end your membership for one of these reasons, we will not refund the current month. You can appeal by contacting us.
We may also end your membership for any other reason by giving you one month’s notice and refunding any period you have paid for but not had.
10. Changes to these terms
We may update these terms. If a change materially affects you, we will give at least 30 days’ notice and you may cancel before it takes effect.
11. Complaints and law
If something is wrong, please tell us — contact details are on our privacy page and in the footer of every page. We will try to sort it out.
These terms are governed by the law of Scotland, and the Scottish courts have jurisdiction. This does not affect your statutory rights as a consumer.
